CONSENT STATUTES BY STATE

Welcome to the ATIXA Consent Statutes page!

The Violence Against Women Act, Section 304 requires an institution’s Annual Security Report to include “the definition of consent, in reference to sexual activity, in the applicable jurisdiction.” To aid institutions in complying with this requirement, we have created a clearinghouse of consent statutes by state, as of April 2018.

Additionally, VAWA Section 304 requires an institution’s Annual Security Report to include “the domestic violence, dating violence, sexual assault and stalking in the applicable jurisdiction.” Please utilize the resources below to find your state’s definitions of the following:

Rape and sexual assault
Domestic violence
Stalking

Also, the Rape, Abuse, and Incest National Network (RAINN) maintains another state-by-state consent laws resource.
