Welcome to our 2020 Title IX Resource Center. It’s a brave new world, and ATIXA wants to help you navigate it. As you know, OCR issued the first new Title IX Regulations since 1975. These Regulations have the force and effect of law and were promulgated subsequent to notice and comment rule-making in compliance with the Administrative Procedure Act.

All education programs that are federal funding recipients, including public K-12 schools and districts, private and public colleges and universities, publicly funded camps, medical schools, federally-subsidized scouting troops, charter schools, hospitals that take federal money for residency programs, private/independent schools that take federal school lunch subsidies, etc. must be compliant with the Final Rule on or before August 14, 2020, or risk losing their federal funding.

The 2020 Regs offer new rules that will require substantial changes for all colleges, universities, and K-12 schools and districts. Guide to Title IX Compliance for Hospitals

On May 6, 2020 the OCR released new Title IX regulations mandating several major changes to the internal sex-based misconduct resolutions currently used by most recipients of federal funding for education programming and activities. One group that may not have been paying close attention is hospitals.

Specifically, hospitals with residency programs operated in partnership or affiliation with a medical school may have Title IX obligations pursuant to recent court decisions that determined such programs fall under the broad umbrella of “education programs and activities” identified by Title IX as subject to the statute’s provisions. Hospitals without Title IX compliance programs should begin those efforts now in order to come into compliance with their legal obligations.

Guide to Controlling Evidence and Cross Examination in Hearings

Whether you’re a hearing chair, a hearing officer, or an appeals officer, you need to know what kinds of evidence are permitted, what kinds of evidence should be excluded, how to explain decisions not to admit evidence, and how to control questioning.

Yes, the regulations are more focused than ever before on K-12 schools and districts. Some of the biggest changes the new Title IX Regulations bring are rigorous due process requirements, with many hoops to jump through, and a commitment to transparent resolution of discrimination allegations by schools. The regulations lay out complex standards for investigating possible policy violations, to assure an investigation that is thorough, reliable, and impartial.
