OVERVIEW

As campuses work diligently to bring processes into compliance with Title IX, some of the more vexing challenges include:

  • Cross-constituency complaints (student-on-faculty, faculty-on-staff, etc.);
  • Varied processes for resolving allegations involving students, faculty, staff, unionized employees, etc.;
  • Different processes for discrimination allegations (race, disability, age, etc.) than those used to address Title IX-related allegations;
  • Balancing Title VII and Title IX by incorporating equity standards into employee-on-employee allegations;
  • Reconciling allegations that include both Title IX-covered behaviors and those standing outside Title IX.
  • Getting up to speed on ALL OF THE CHANGES OCR now requires with the 2020 Regulations!

Given the complexity of addressing these challenges separately – and many others inherent in good policy – many schools and campuses are realizing that patched policies and procedures just aren’t going to cut it going forward. New Regs require a clean-sheet approach. We’ve revisited everything within the previous 1P2P model to ensure that our new models capture all the policy and procedural elements you will need, and reflect the emerging changes in case law as well.

THE PREVIOUS ONE POLICY, ONE PROCESS APPROACH

ATIXA has pioneered the One Policy, One Process Model (1P1P for short), now in use at hundreds of schools and colleges. If you were unsure whether it is time to unify policies and procedures, OCR has made it clear in the new Regs that it expects consistency across processes.

This model permits all discrimination complaints (age, race, sex, gender, nationality, etc.) to be resolved using one institution-wide policy, and one resolution process, applied to all alleged discrimination involving faculty, students and staff.

This process can sit outside existing processes, or can be integrated into existing human resource, affirmative action, and student conduct models. It harnesses the existing resources of many departments to minimize the need for added staff and expense.

The New 1P2P is not only Title IX compliant, it serves the best practices of the civil rights approach with an emphasis on meaningful remedies, social justice, victim empowerment and advocacy, comprehensive investigation, procedural fairness to all parties, and prompt resolution of everything from bias incidents to stalking, sexual assault, sexual harassment and dating and domestic violence.

WHAT IS THE MODEL POLICY?

The ATIXA One Policy, Two Procedures Model is a unified policy addressing sexual misconduct and other forms of discrimination. The Model covers everyone equitably with the same kind and degree of protection of their rights.

WHY CHOOSE A UNIFIED PROCESS?

A unified process can be centrally administered and overseen, often by expanding the Title IX Coordinator role in the form of an institutional equity officer. Unification simplifies the investigation function and avoids duplicative training when there are multiple bodies all resolving the discrimination allegations across the campus or district.

Unification allows consistent sanctions and responsive actions for the same types of misconduct, whether the misconduct involves a student, faculty, or staff member. Unification fosters collaboration across the departments that are stakeholders, including HR, student conduct, and academic affairs while retaining their needed voice in the resolution process. Critically, a unified process can also be essential to the detection and tracking of patterns of misconduct, to limit the frequency of repeat offenses.

Unified models are becoming the industry standard approach. For those who fear that campus cultures or politics will not accept a unified approach, we suggest that the momentum created by the new Regs will make this the right window of opportunity to champion such sweeping change.

It will also be easier in the long run to fix it now, rather than to Band-Aid existing processes not designed for 2020 compliance in the hopes they will suffice. Our hope is that now is the time to envision what can and should be done, and to lay the groundwork for a unified policy and resolution model on your campus.

Will we receive updates to the 1P2P Model if it is updated?

Why should we consider implementing the 1P, 2P Model?

The 1P2P is the only unified civil rights-based policy model of its kind. One Policy, Two Procedures transforms and simplifies an institution’s approach to addressing civil rights-based violations by:

Is the 1P, 2P Model just for Title IX compliance?

No. While 1P2P is produced and sponsored by ATIXA, the beauty of 1P2P is that it is intended to address all civil-rights based violations (e.g.: sex, gender, race, disability, ethnicity, sexual orientation, age, religion etc.). “One Policy, Two Procedures” doesn’t just facilitate resolution within a siloed process for a single act of discrimination but facilitates a unified resolution for all civil rights-based issues for all constituencies.

Does the 1P2P Model replace the student conduct process?

No. Using the model can incorporate the existing student conduct process, supplant it just for Title IX allegations, or supplant it for all discrimination allegations, if desired. Now that a live hearing is required by the 2020 OCR Regs, there is no good reason why discrimination and student conduct resolution mechanisms (or faculty resolution mechanisms, for that matter) should differ substantially.

Does the 1P2P Model do away with hearings?

No. It allows avoidance of a hearing if the parties elect for informal resolution, but 1P2P is designed to allow hearings where required. 1P2P provides for informal resolution, conflict resolution, and formal resolution options.

How does the 1P2P Model address at-will employees with no hearing rights?

Under the new OCR Regs, at-will employees may have hearing rights. The model reflects this.
