How does OCR define “directly related” evidence within the regulations?
Answer:
The new Title IX Rule does not contain a definition of “directly related to the allegations” so the phrase must be given its ordinary meaning. Note that this phrase was selected for the Rule in part because the “directly related” language aligns with FERPA. The Preamble to the Rule discusses this at, for example, pages 1451-53.
