As you know, hospitals have long been tasked with Title VII Compliance, but now Title IX has been added to the mix as well. That said, an appeals court recently applied Title IX to a hospital residency program for the first time, and now you are wondering what you need to do as a result. Fortunately, we can guide you.
This recent case holds that hospitals with medical residency programs that accept federal funds are subject to the same requirements as educational institutions with respect to Title IX. This means that hospitals will need to designate a Title IX Coordinator, have equitable investigation and resolution procedures in place, comply with detailed OCR guidance, offer training to hospital staff and employees on Title IX, conduct Title IX investigations in a fair and timely manner, and remedy sex/gender discrimination in accord with OCR’s precepts.
Like Title VII, Title IX has many nuances to master. It is subject to dual enforcement, by agencies and the courts, but unlike Title VII, there is no EEOC consent to sue requirement under Title IX. The regulations on Title IX can lack clarity and we are already hearing from hospitals looking to engage outside assistance with their compliance efforts. This case encourages those in the health care industry to take the opportunity to review best practices for mitigating the risks associated with sexual harassment, sexual assault, and other hazards of operating medical residency and other educational programs – areas where our team can certainly assist.
