Title IX Hearing Advisors

10:00am-3:00pm ET

This course focuses on the skills needed to serve as an effective hearing advisor during the Title IX resolution process and addresses an advisor’s scope and function, including interacting with the hearing chair. Participants will learn how to raise concerns about procedural issues, reduce bias and conflict of interest, and apply the rules of questioning and cross-examination.

This course is useful for advisors chosen by the parties and advisors appointed by the institution. Participants will hone their questioning skills, including cross-examination of the other party and any witnesses and how to navigate appeals.

Advisors can be involved in the entire resolution process, from initial intake to final appeals. This course explains the advisor’s role at every stage, including supportive measures, dismissals, emergency removals, investigations, informal resolutions, hearings, and appeals. Title IX Decision-Making for Higher Education (2024 Regulations)

This course is focused on cultivating the skills and insights needed to successfully serve as a hearing officer and decision-maker for Title IX complaints. This training meets the requirements under Title IX and VAWA Section 304 to help decision-makers recognize and overcome bias and ensure equity for all parties.

For individuals serving as hearing chairs, panelists, single decision-makers, administrative hearing facilitators, and party advisors, this training will underscore decision-making skills so that decisions are sound, supportable, and less susceptible to future challenges, such as in litigation. Live Hearings for Higher Education (2024 Regulations)

Live Hearings for Higher Education focuses on the skills needed to run an effective live hearing as part of the Title IX Formal Grievance Process or involving other types of civil rights complaints or misconduct. Topics include hearing preparation, pre-hearing meetings, facilitating questioning or cross-examination, and deliberation.

This training complements ATIXA’s Title IX Higher Education Decision-Maker course. It is relevant for all professionals serving as hearing chairs, panelists, single decision-makers, administrative hearing facilitators, and party advisors. Writing Outcome Rationales Workshop

Proficiency in writing precise rationales is essential for both investigators and decision-makers during the formal grievance process. Rationales are intricate and require significant analytical and writing abilities to effectively convey the practitioner’s thoughts. This includes analyzing all relevant facts, applying policies, assessing credibility, applying the standard of proof, making a final determination, elaborating on sanctions, and providing reasons for the decision.

While understanding the rationale is important, articulating it in writing can be challenging. This workshop helps attendees find their voice, decide how much to say, and the best way to convey it. Click here to learn more.

Managing Appeals Seminar

3:00pm-5:00pm ET

This seminar provides participants with the philosophical and practical framework for managing appeals consistent with ATIXA’s best practices to achieve equity and compliance with federal requirements under Title IX and VAWA Section 304. ATIXA’s expert faculty members guide participants through the appeals process, how to determine whether a party has “grounds” for an appeal, and how to assess whether the federally required grounds for appeal are met. This seminar will focus on all four phases of “appeal,” including dismissal appeals, supportive measure appeals, emergency removal “appeals,” and hearing/decision appeals.

In addition, participants will learn how to compose solid rationales, apply the principles of appellate excellence (including deference, the clear error standard, and the use of remand), make determinations based on merits, communicate outcomes, and avoid common pitfalls. Individualized discounts are as follows:

  • 1st registration – full price of registration
  • 2-4 registrations – 15% discount per line item
  • 5+ registrations – 25% discounted per line item

There are scholarships available for the Decision-Making & Appeals Focus Week. Scholarship applications can be submitted on a rolling basis up to the opening date of the event. If your application is approved, you will be notified within 2 weeks after your application has been submitted.

Those attending a certification course will receive a certification for the course as well as recertifying credits (CCCs) for any current certification for a 2-year time period.

All our courses, workshops, and seminars will receive a digital badge denoting completion. Workshops & seminars will provide 4 recertification credits and 2 recertification credits, respectively towards any active certification.
