ATIXA’s One Policy, Two Procedures Model Policy: Version 5 (1P2P) (2020 Regulations)

A comprehensive non-discrimination policy and procedures for higher education institutions for the 2020 Regulations.

The premise of 1P2P is that resolution of all forms of discrimination should be the same for all members of the school community. This model applies to all students and employees and covers all forms of sexual misconduct (the “Big Five” offenses and beyond, such as sexual exploitation), plus all other forms of protected characteristic discrimination (race, religion, ethnicity, age, disability, etc.). In addition to a Section 106.45-compliant model (Process A), 1P2P offers a full alternative civil rights process for resolution outside of Section 106.45 (Process B). 1P2P is also compliant with the Violence Against Women Act Reauthorization of 2013 requirements. A comprehensive non-discrimination policy and procedures for higher education institutions for the 2004 Regulations.

ATIXA’s One Policy, One Procedure (1P1P) Model will save you time, ensure compliance, and enshrine best practices. The 1P1P has long been considered the industry standard for excellence in policies and procedures that comply with Title IX. This model offers language to guide institutions with respect to the policies and procedures required under the 2024 Title IX Regulations, and it unifies responses to all forms of discrimination for students, faculty, and staff.

ATIXA’s Model Policies and Procedures (AMPP) (2020 Regulations)

Sex- and gender-based discrimination policy and procedures for higher education institutions for the 2020 Regulations.

This model is compliant with the 2020 Title IX regulations. It can be applied to students and/or employees for the “Big Five” offenses only (sexual harassment, sexual assault, dating violence, domestic violence, and stalking). AMPP incorporates a Section 106.45-compliant (Process A) model. It assumes users already have a student or employee conduct process (Process B) in place as an alternative when Process A does not apply. Click here to view.

Sex- and gender-based discrimination policy and procedures for higher education institutions for the 2024 Regulations.

The AMPP is a streamlined version of the 1P1P model. Whereas 1P1P addresses all forms of discrimination (race, age, religion, disability, etc.), the AMPP more narrowly offers model policies and procedures for Title IX (sex/gender) compliance only. Some institutions use a unified approach, while others prefer stand-alone policies and procedures to comply with Title IX. This policy is included in ATIXA Membership & available for purchase. ATIXA’s K-12 Model Policies and Procedures (K-12 AMPP) (2020 Regulations)

Sex- and gender-based discrimination policy and procedures for K-12 schools and districts for the 2020 Regulations.

ATIXA recognizes that schools vary in size, structure, governance, capacity, and resources and has drafted this model to comply with the federal 2020 Title IX Regulations. This model policy and procedures can be implemented for students and employees at large or small K-12 school districts and within public, private, charter, or independent K-12 schools. It applies to the big five offenses only (sexual harassment, sexual assault, dating violence, domestic violence, and stalking) and assumes users already have a student or employee conduct process (Process B) in place as an alternative when Process A does not apply. ATIXA Advisors Model Policy (2020 Regulations)

ATIXA Mandated Reporter Policy (2020 Regulations)

This model policy outlines the legal context and guidelines for all employees to follow regarding mandated reporting of concerning behaviors, discrimination, harassment, and crimes. It incorporates requirements from the Clery Act (as amended by VAWA Section 304), Title VII, and Title IX, as well as recommended expectations for reporting to the institution’s behavioral intervention team (BIT) or CARE Team. This model policy provides guidance for the presence of minors on college/university campuses outside of approved youth activities and sets forth mandatory child abuse, neglect, and abandonment reporting requirements that promote the safety and well-being of minors and comply with state laws. ATIXA Model Policy: The Title IX Rights of Pregnant and Parenting Students (2024 Regulations)

Title IX provides protection for pregnant and parenting students to ensure that they can equitably access their school or college’s education program or activity both during pregnancy and after childbirth if desired. This model policy outlines an institution’s compliance obligations under the law, as well as the process a student can use to file a discrimination complaint on the basis of pregnancy or parenting status.

NABITA Model Policy on Voluntary and University-Initiated Leaves of Absence and Withdrawals

This model policy and procedures supports and facilitates a safe and healthy learning environment and promotes the well-being of the institutional community. This policy outlines a process for student-initiated voluntary leaves of absence as well as university-initiated leaves of absence. Both a student-initiated and a university-initiated leave of absence allow a student to take time away from the university environment to address the behaviors or tend to  the circumstances that necessitated the leave so that the student can return to the university and resume their studies. TNG Model and NCAA-Compliant Serious Misconduct Policy

In addition to complying with the NCAA Sexual Violence Policy requirements, the template also includes our recommendations for collecting information related to additional serious misconduct that is relevant to athletic eligibility and overall community safety. Click here to view.

TNG developed this model policy/protocol to outline a process that adheres to the research-based recommendations found in ATIXA’s 2022 Whitepaper: Recommendations for Non-Discriminatory Approaches to Address Criminal and Disciplinary History in the College/University Admission Process.

The Model Code of Student Organization Conduct

In collaboration with a team led by Dyad Strategies, managing partner Scott Lewis, J.D. co-authored this model policy to assist colleges and universities in more effectively responding to allegations of student organization misconduct. By providing a framework for consistent models of investigating and adjudicating student organization misconduct, practitioners can help make campuses safer by more effectively addressing the dangerous behaviors being perpetrated by some campus student organizations.
